Charles F. Hudson

Counsel to the Firm

Chip Hudson is a real estate and commercial litigator, representing clients in matters involving eminent domain, land use and administrative law. He has been recognized by The Best Lawyers in America® for his work in Eminent Domain and Condemnation, and was named Portland’s “Lawyer of the Year” for 2016, 2017, and 2022 by Best Lawyers® in that practice area.

Chip represents clients before government agencies, in state and federal trial courts, and in appellate proceedings, where several cases have produced landmark decisions.

Chip’s eminent domain practice includes work on behalf of individual and business clients, as well as representation of utility companies and local government agencies. He frequently speaks on topics related to eminent domain and access law.

Chip also represents business clients, including financial institutions, in a variety of other real estate and commercial disputes.

In his spare time, Chip enjoys backpacking and river running.

He has been with Lane Powell since 1983.

Represented landowners in utility condemnation actions.
Gas Transmission Northwest LLC v. 15.83 Acres of Permanent Easement, et al.
Represented plaintiff in federal condemnation of a pipeline under the Natural Gas Act.
ODOT v. Alderwoods (Oregon), Inc., 358 Or 501 (2015)
Represented defendant property owner in a leading appellate decision on the scope of abutting rights of access.
City of Tigard v. Bonita LLC
Represented owner in condemnation of land affected by wetlands, obtaining a revised wetlands delineation and substantial increase in compensation.
Washington County v. Commercial Enterprises, LLC et al.
Represented shopping center owner in condemnation of land and access, obtaining settlement for increased monetary compensation and the preservation of highway access.
Friends of Yamhill County v. Board of Commissioners, 351 Or 219 (2011)
Represented Measure 49 claimant through extended administrative and appellate process resulting in a leading decision implementing ballot measure.
City of Beaverton v. Microclimates, Inc.
Represented city in condemnation of substantial utility assets. Successfully defended challenges to condemnation authority, after which the condemnation case and related contract litigation were settled.
Washington Water Power v. Union Pacific Railroad
Co-counsel in successful defense of 5-year “test case” condemnation litigation. Final settlement included multi-state agreement for railroad and utility crossings.
International House of Pancakes, et. al. v. State of Oregon Dept. of Transp.
Obtained injunction requiring ODOT to condemn property owners’ rights of access prior to closure of a frontage road.
Alsea Veneer, Inc., et al. v. State of Oregon, et al., 318 Or 33 (1993)
Co-counsel for plaintiffs in a successful class action for employer beneficiaries of the State Accident Insurance Fund.
Altimus v. State of Oregon, 513 US 801 (1994)
Appellate counsel for defendant property owners in the first case nationally to apply Dolan v. City of Tigard’s principle of rough proportionality to the evidentiary use of exactions in condemnation cases.
