Carin A. Marney

ShareholderSenior Living & Long Term Care Team Co-Chair

Carin Marney, Co-Chair of Lane Powell’s Senior Living and Long Term Care team, represents health care and long term care providers in regulatory and litigation matters. She has deep experience advising clients in this highly-regulated industry on compliance and helping them avoid and also resolve disputes, both in and outside of court.

Carin has extensive experience defending businesses, owners, managers, and operators in commercial and employment litigation, in court, administrative proceedings, and arbitration, including claims involving allegations of discrimination, retaliation, Fair Housing Act, disability discrimination and failure to accommodate claims, and leave interference claims. Her litigation experience often intersects with defending employers in regulatory enforcement action brought by state and federal agencies. Carin provides advice on employer best practices, investigations into employee conduct, risk management, and investigations including those instituted by regulatory agencies.

Carin works with a range of long term care providers, including:

Skilled nursing;
Assisted living;
Independent living facilities;
CCRCs;
Long term acute care hospitals;
Dialysis clinics; and
Other health care providers.

Carin has defended long term care clients and other health care providers throughout the Pacific Northwest in high profile litigation involving allegations of neglect and abuse of vulnerable adults and wrongful death. She also routinely advises and represents clients in regulatory matters, such as resolving and avoiding licensing disputes, survey enforcement actions including civil money penalties (CMP’s), Informal Dispute Resolution (IDR) and administrative appeals, compliance programs, transfers and discharges, risk management, and disciplinary actions.

Licensing investigations and hearings involving the Department of Health; licensing of individuals, i.e., nurses, nursing home administrators
Advice and preparation of Business Documents
Risk management and Managed Risk Agreements
Resident rights issues, including Discharge Proceedings
Admission Agreements, Policies and Procedures, and Resident Handbooks
Employee training on best practices
Litigation
Defending all types of long term care facilities sued for wrongful death, neglect, abuse and negligence
Fair Housing Advice
Arbitration Agreements

Carin also represents businesses and other professionals in complex litigation involving commercial and professional liability disputes. She represents businesses, employers, and other professionals in regulatory action and litigation for wrongful discharge, discrimination, wage and hour violations, and related workplace claims.

Brookdale Senior Living, Inc. Portfolio Financing, Entity Restructuring and Acquisition
Counseled Brookdale Senior Living in connection with separate FNMA and FHLMC portfolio financings, and assisted with entity restructuring after the major acquisition of a Washington-based company that is, like Brookdale, an owner/operator of senior living facilities on a nationwide basis.
