Andrew G. Yates

Shareholder

Andrew Yates represents a wide variety of businesses in complex civil litigation and regulatory enforcement actions. He has tried numerous cases to verdict in state and federal court. He also regularly handles arbitrations. In addition to general commercial litigation, Andrew regularly represents clients in disputes arising in the railroad, aviation, insurance, financial services, and food and beverage industries.

Railroad Litigation Experience

Andrew represents several of the nation’s largest freight and passenger railroads, including BNSF Railway Company, Union Pacific Company, and Amtrak. He has defended these and other rail companies in Federal Employers’ Liability Act, Federal Railroad Safety Act, and tort claims involving derailments, grade crossing accidents, and other incidents in state and federal court and before federal administrative tribunals. Andrew is a member of the National Association of Railroad Trial Counsel and the Association of Transportation Law Professionals.

Financial Institutions Litigation Experience

Andrew’s practice also includes representation of banks, loan servicers, mortgage companies, and other financial institutions in a wide variety of court and administrative proceedings, such as regulatory investigations and enforcement actions. He defends class actions and individual claims under federal statutes such as the Truth in Lending Act, Real Estate Settlement Procedures Act, and Fair Debt Collection Practices Act, as well as state statutes and common law causes of action.

Insurance Litigation Experience

Andrew regularly represents insurers in life insurance policy litigation and first party coverage and bad faith matters. He handles matters at all stages of the dispute process, including pre-suit mediations, complex litigation, and appeals.

Other Civil Litigation Experience

Andrew has also represented clients in a wide variety of other civil litigation matters, including in the manufacturing, hospitality, maritime, real estate, and health care industries as well as business disputes between partnerships, closely held businesses, and individuals. These matters include pre-dispute negotiations, mediation, arbitration trial in state and federal courts, and appeals.
