Callie Castillo was quoted in a March 2 Law360 article, “Wash. Judge Strikes Down State Capital Gains Tax.” The article discusses how a state judge ruled that Washington’s new seven percent capital gains tax is unconstitutional.
“Callie A. Castillo, a shareholder at Lane Powell PC and an attorney for the plaintiffs, told Law360 on Wednesday that Judge Huber followed the analysis put forth by the team for the plaintiffs.
‘This capital gains tax in Washington cannot be considered an excise tax and has all the hallmarks of an income tax,’ Castillo said. ‘We're extremely pleased.’
Castillo said the one disappointment the plaintiffs have is that the judge did not reach federal constitutional issues. The plaintiffs contend the tax runs afoul of the U.S. Constitution's commerce clause, but the judge did not address that. She said she is confident the issue will come up again on appeal.”
