The Alaska Supreme Court agreed with Lane Powell in unanimously affirming the trial court’s dismissal of intellectual property and defamation claims on summary judgment for Firm Client Keller Williams Alaska Group. The Alaska Supreme Court confirmed that the plaintiff had no evidence of any damages, that statements contained in a property appraisal were not defamatory as a matter of law and that the claims were pre-empted by the federal Copyright Act. The court also approved the trial court’s award of over $55,000 in attorney’s fees to the defendants.
Lane Powell Attorneys Matt Claman and Jim Stoetzer prepared the briefing in both the superior court and the Alaska Supreme Court, and Tiffany Scott Connors assisted with the IP issues. Claman also presented the oral argument in both courts.
