Successfully represented client Lundberg LLC in a trade secret litigation case. A jury in the Western District of Washington awarded plaintiff Lundberg over $5 million in damages for trade secret misappropriation and breach of a non-disclosure agreement. Lundberg sued former business partner TSI, Inc. alleging that TSI stole Lundberg’s confidential information and trade secrets to launch its own competing air pollution control equipment line. TSI hired away one of Lundberg’s top two air pollution control engineers and another former Lundberg engineer to help start TSI’s new product division. After a two-week trial, a jury entered a verdict awarding Lundberg its lost profits and additional trade secret damages. Lundberg will now seek an injunction and exemplary damages and attorneys’ fees under the Washington Trade Secrets Act. After the jury verdict, TSI urged the Judge to overturn and dismiss the verdict for a variety of reasons. However, the Judge denied the motion for judgment and ordered TSI to pay $1 million in exemplary damages and approximately $1.2 million in attorneys' fees on top of the initial verdict. Additionally, he granted Lundberg's injunctive relief bid, ordering TSI to stop using Lundberg's air pollution technology and to destroy all products and parts derived using Lundberg's trade secrets.
